Since the City Council early meetings (Administration 4:00 pm and Public
Works 5:00 pm) are not televised, and are frequently not covered by any news
source I thought many of you may be unaware that we did discuss a different
ordinance at the Monday Administration meeting. It follows;
"Any person who willfully and lewdly exposes their breast(s), in any public
place, or in any place where there is present another person or persons who
are offended or annoyed thereby is guilty of a misdemeanor."
Lewd: involving or being sexual, conduct that is considered indecent or
offensive.
Gender neutral, emphasis on a specific act not breasts and act must be done
lewdly. I had hoped this would have been a compromise ordinance.
As you know I did not support the ordinance that passed for many reasons a
few being, I think it poorly written, difficult to enforce and will cost
taxpayers too much if (when) it is challenged in court; in addition I think
the punishment is out of line. I do not think it rises to the occasion to
be an arrestable offense.
I know each council member and the mayor did take this issue serious, and
did what they believed would be best.
I respect the other council members and the mayor's opinion, though I do not
agree. A council that always agrees, in my opinion would be a true
misrepresentation of the community, but I am not convinced the vote taken on
Monday does represent fairly the community's opinion, but I will abide by
the majority opinion while disagreeing.
