Final Farewell to the 4th Amendment?



It was announced today that the Supreme Court will
decide whether it is consitutional for police to set
up roadblocks to stop motorists, with no probable
cause, and essentially submit them to drug-dog
searches of their vehicles.

Roadblocks of this nature have been used in
Indianapolis where at least two roadblock detainees
challenged their consitutionality.  A federal appeals
court ruled that the 4th Amendment had indeed been
violated by the program.  Now the Supreme Court (whose
current makeup has not been particularly kind to 4th
Amendment advocates) will once again decide how much
further our right to not be unreasonably searched will
be eroded.

There is very little evidence to support being
optimistic about the outcome.

Remember, the same people who draft and pass drug
legislation based on politics rather than science and
rationale, who set up this kind of roadblock program,
train the dogs, and use valuable law enforcement
resources to implement the enforcement, all under the
auspices of "fighting the Drug War" can (and often do)
gather at a local bar after work and get legally
intoxicated on alcohol, arguably the most destructive
drug in our society.

Our silence is deafening.
