While new to the group, I'm going to jump into the search-and seizure issue on an oblique angle. There have bee alot of comments as to how this is accomplished in schools and the need/ability for school administrations to skirt the issues of individual rights because of the status of juveniles in America. Is there anyone else out there that thinks there shouldn't be two Constitutions and the rights and obligations that attach? By that I mean one for "adults", and one for juveniles? Try as I might both in and out of law school, I couldn't find any mention that the constitution only kicks in at a certain age. When I read that "All persons shall be safe from searches and seziures unless probable cause....etc" I can't find that this only kicks in at some magical age.
There is a great push in the criminal justices system to start adjudicating and sentencing juveniles as adults, so be it, but when are all the other rights going to kick in for juveniles?
