1.      Approval of  Minutes of November 12, 2002,  2002 -  Chris Bainbridge

 

2.   Application for New Alcohol License from "Emperor of India" - Chris Bainbridge

Praveen Khurana, owner of "Emperor of India" restaurant located at 517 S. Main Street, has submitted an application and fees for restaurant certification, and alcohol license for beer and wine for on premise consumption.

ACTION:  Recommend approval of issuance of restaurant certification and alcohol license to Emperor of India, 517 S Main Street, pending approval of inspectors, police department investigation, and obtaining required State and Latah County licenses.

 

3.  Proposed Moscow City Code Amendment, Title 4 Chapter 2 Code Amendment Proposal to Reduce Required Front and Street Side Yard Setbacks in the R-2, R-3, and R-4 Zoning         Districts - Joel Plaskon

            Staff proposed reductions in required front and street side yards setbacks for properties fronting 80'           wide rights-of-way due to what can be viewed as an undue burden on such property owners.  Staff is             now providing the Historic Preservation Commission's recommendation to reject the proposed           ordinance as well as the list of street names associated with the 80' wide rights-of-way.

            ACTION:  Recommend accepting information presented by staff and direct staff to proceed as    deemed appropriate, including scheduling of a City Council public hearing on the matter as decided       upon by the Council February 19, 2002; or take such other action deemed appropriate.

 

4.         Receipt of Planning and Zoning Commission Recommendation on Joint Application by Latah      County, Moscow School District, First Presbyterian Church, and City of Moscow, for Comprehensive Plan Map Land Use Designation Amendment and Rezoning - Joel Plaskon

Moscow Planning and Zoning Commission held a public hearing November 13, 2002 to consider Comprehensive Plan Map Land Use Designation Amendment and Rezoning for the properties known   as the Latah County Courthouse, Moscow High School, First Presbyterian Church and the 1912 Center.  Idaho Code requires that notice of the public hearing before the City Council not be    published until the City Council has "received" the recommendation of the Planning and Zoning      Commission.

            ACTION:  Acknowledge receipt of Planning and Zoning Commission's recommendations on subject         application; or take such other action deemed appropriate.

2.    Accounts Payable for October, 2002 - Don Palmer

4     Resolution of Intent to Create LID #132 - Dave Klatt/Mark Cook

The City is in receipt of a petition containing more than 93% of the resident property owners.  The preliminary engineering has been done on the project and that information has been given to the interested parties.  The L.I.D. still appears to be viable.  Consequently, the first step in the formation process is to pass the Resolution of Intent to Create the L.I.D.  This will cause a public hearing to be set for December 2, 2002 at which time the Council can consider passage of the Ordinance which will create the L.I.D.

ACTION:  Approve Resolution of Intent to Create L.I.D.; direct staff to complete public notification and develop ordinance to create L.I.D.; and set public hearing for 7:30 p.m., December 2, 2002.

 

5.         Fire Station Agreement #3 - Gary J. Riedner

            Fire Station #3 was designed to meet the City's fire suppression and emergency medical services needs and to accommodate storage of equipment for Moscow Rural Fire District.  This matter was brought before committee October 21, 2002, at which time changes to the agreement were suggested.  A new draft is being presented to committee today, which will ultimately need approval from the MRFD commissioners.

 

            ACTION:  Recommend approval of the agreement pending MRFD approval.

 

6.         Delinquent Account/Collection Policy - Don Palmer/Dan Weaver

            In an effort to provide equitable services to city of Moscow ratepayers, and to aid in the enforcement of payment of services, staff is recommending implementation of a formal collection policy to include enlisting the assistance of an outside collection agency.

 

            ACTION:  Review staff recommendations and direct staff further.

2.         7:30 p.m. Public Hearing - Community Development Block Grant Application - Brant Kucera

            This proposal is to submit an application for an Idaho Community Development Block Grant for downtown revitalization.  The city is applying for $500,000 to address ADA, signage,  infrastructure and amenities issues in the downtown core and Friendship Square as identified by the   Moscow Downtown Revitalization Plan.  The City has identified $1,038,538 in match from in-kind services and projects completed and planned in the downtown area.

ACTION:  After conducting public hearing and considering testimony and the project, approve proposed grant application; or take such other action deemed appropriate.

4.         1912 Center Status Report- Randy Rice

At the City Council meeting of September 19, 2002, direction was given to revisit project fundraising opportunities and to consider development of a plan to address many of the unresolved  issues associated with the project.  Staff now present information received from the fundraiser along with a recommendation of completing a business plan to coincide with the anticipated kickoff of the fundraising process in approximately ninety days.

 

ACTION:  Accept staff and fundraiser recommendations as presented; modify as deemed appropriate; or take such other action deemed appropriate.

 

5.         Voluntary National Pollution Discharge Elimination System Phase II Program for Moscow - Mark             Cook

            Staff presented Phase II program materials to council on two previous occasions: October 14, and November 11, 2002.  USEPA Region 10 and Association of Idaho Cities both reference that Moscow will likely be regulated as a Phase II community on December 9, 2002.  In that regard, staff has prepared a voluntary Phase II program for Council consideration.

 

ACTION:  Direct staff to submit a voluntary Phase II program for United States Environmental Protection Agency Region 10 consideration by December 9, 2002 and authorize the Mayor's signature on transmittal documents submitted this program; or take such other action deemed appropriate.
