1.	Minutes of September 5, 2000

2.	Request from Native American Student Association for Support of their 
Annual Pow Wow - Gary J. Riedner	
The University of Idaho Native American Student Association is hosting its 
Annual Pow Wow November 3 and 4 at the Kibbie Dome.  They are requesting 
the City of Moscow's support in the amount of $1500.  The Council created a 
budget line item in the FY 2001 budget for Diversity Initiatives and funded 
it in the amount of $1500.

ACTION:  Recommend supporting the NASA in the amount of $1500.00; or take 
such other action as deemed appropriate.

3.	Revised Ordinance Creating the Fair Housing Commission - Dale Pernula
The Mayor appointed a five member Commission after the Code was adopted 
specifying a four member quorum for up to a nine member Commission.  We 
currently have solicited members and five Commission members have been 
appointed.  We need to amend the Code to define quorum as a majority of the 
appointed members because a quorum of four is too large for a five member 
Commission.  Staff recommends adopting the proposed Ordinance amending MCC 
Title 3, Ch. 6 to define a quorum of the Moscow Fair Housing Commission as 
a majority of the appointed members.

	ACTION:  Reject proposal or adopt proposed Ordinance on first reading or 
under suspension of the rules requiring three complete readings and that it 
be read by title only.

4. 	Amendments to City Code Making Certain Violations Infractions Rather 
than Misdemeanors -Randy Fife
 The State of Idaho, through Senate Bill No. 1361, grants cities the 
ability to create infractions.  In reviewing the Moscow City Code, several 
sections would serve our citizens better if those sections were changed 
from misdemeanors to infractions.  The attached proposed ordinance would 
implement those suggested changes.  Reviewed by Administrative Committee 
September 5, 2000, and September 18, 2000.

	ACTION: Reject ordinance; or approve ordinance on first reading under 
suspension of the rules requiring three complete and separate readings, and 
that it be read by title only.

5.	Hahn Lot Division - Dale Pernula
	The proposal is to divide Lot 3 of the Replat of Lot 2 of Hatley Addition, 
creating lots of 1.49 and 1.77 acres located north of the Appaloosa Horse 
Club.

	ACTION:  Approve proposed lot division.

6.	Miller/Dailey Lot Line Adjustment - Dale Pernula
	A lot line adjustment of 8' x 60' from Millers at 247 Cherry Street to 
Dailey at 717 W. "C" Street.  Both lots currently meet the minimum lot size 
(area) and width requirements of the R-2 Zoning District and the adjusted 
lots would also meet those requirements.  Additionally, the lot line 
adjustment would allow the Dailey home to comply with the side yard setback 
requirement, which it does not meet currently.  There are no utility issues 
involved.  Staff recommends approval of requested lot line adjustment on 
consent with no conditions.

	ACTION:  Approve, with or without conditions, or deny the proposed lot 
line adjustment.	

7. 	Resolution regarding "Undoing Racism Day." - Gary J. Riedner
	The National League of Cities has requested each member city to join in a 
campaign to "undo" racism in our nations cities by adopting September 20 as 
"Undoing Racism Day" in the City of Moscow.

	ACTION:  Adopt Resolution or take such other action deemed advisable.

	The City of Moscow has received a number of inquiries regarding the 
placement of cellular towers in various areas of town.  After reviewing 
zoning code provisions, the placement of such towers is not properly 
regulated by our current codes.  A moratorium for 120 days would permit the 
preparation and review of an ordinance establishing rules for such 
structure before some have been installed.

	ACTION:  Reject proposal; or approve enclosed ordinance declaring 
moratorium on issuance of permits for antenna/towers in excess of 
thirty-five feet in height on first reading or under suspension of the 
rules requiring three readings and that it be read by title only.

             D.  	Request from Native American Student Association for 
Support of their Annual  Pow Wow - Gary J. Riedner	
The University of Idaho Native American Student Association is hosting its 
Annual Pow Wow November 3 and 4 at the Kibbie Dome.  They are requesting 
the City of Moscow's support in the amount of $1500.  The City's support of 
this event will help make the visiting guests feel welcome. Reviewed by 
Administrative Committee September 18, 2000.

ACTION:  Support the NASA in the amount of $1500.00 from Legislative line 
item 01-4110-788 Diversity Initiative, payable after October 1, 2000.

2.	Public Hearing - 7:30 p.m. - Application for Comprehensive Plan Land Use 
Designation Change and Rezoning at 605 West Third Street - Dale Pernula
The applicant applied for and received approval in 1998 to rezone a portion 
of the property he owns at this location from R-4 to MB.  Since that time 
he had a number of mini-warehouse storage units built on that property as 
shown on the enclosed site plan.  The current proposal is to expand the MB 
zone within this area confined by railroad tracks to include land leased by 
Palouse River and Coulee City Railroad.  A public hearing on this matter 
was held by the Moscow Planning and Zoning Commission July 26, 2000 
(minutes enclosed).

ACTION:  After conducting public hearing, reject proposal or approve 
enclosed Resolution and adopt enclosed Ordinance on first reading or under 
suspension of the rules requiring three complete readings and that it be 
read by title only.  Findings of fact and a reasoned statement are required 
for this application.
