    This is a tragedy, but it still stinks like last weeks garbage.  How can we keep forgetting that marijuana is illegal?  I can see why customs and oregon law enforcement agencies are all over this guy.  It is not the question of medicinal use, it is a question of amount of DRUGS on hand at a given time.  I have personally never even seen three pounds of marijuana, but I would imagine that it would take a long time for one person to consume it all.

    Take a look at Idaho law in regard to possession of marijuana since I cannot speak for Oregon law. According to Idaho Criminal Code 37-2732 (B)  "any person who knowingly manufactures, delivers, or brings into the state, or who is knowingly in actual or constructive possession of, one pound of marijuana or more, or twenty five (25) marijuana plants or more......  is guilty of a felony, which felony shall be known as 'trafficking in marijuana.' " The penalty according to this criminal code is a MANDATORY minimum fixed term of imprisonment of one (1) year and a fine of no less than five thousand ($5000) dollars.  This code says nothing about INTENT to sell, just POSSESSION.  there does not have to be any sales to an outside party to be guilty of this.

    I don't know if Oregon has a medicinal use law on the books (like Washington), but maybe it would be  good idea for Asbury to protest in support of medicinal use rather than full legalization.  He may stand a better chance at having his voice heard and accomplishing his goal.

    I have no problem with the medicinal use of marijuana, but it needs to be legalized for that use in our state before I can accept and support it.  I do have a friend that is a paraplegic, like Asbury.  He may have pain and complications as a result, but I have never seen him take anything stronger than tylenol or advil to control his pain.  his doctor advised him that was all he needed to use!  and it works!

    Why can't Asbury move to a state that has legalized the medicinal use of marijuana, I bet that he just did not drive his chair to Columbus without support of some kind.  I bet that the people who supported him would help him settle into a new home across the border to the north of his home state.  That seems easier than being arrested....
