The code notes that "Any person, other than a national bank, is not
authorized to use the word "bank" in any business name. Violation of the
code is a
felony. The Secretary of State's Office required that she change the name
of her business establishment so as not to include the word Bank.
Obviously, this alleged felony probably sent waves of fear among Idaho banks
and financial institutions by using the term Bank in it's title. Ms. Sherman
hired a lawyer to see if she could get an exemption to the code. Her
application for a beer and wine license at the county level was turned down
until the name situation was cleared up at the highest Idaho government
levels.
I called the Secretary of States office this afternoon to see if we had some
common sense at the highest government levels. Fortunately, common sense
has prevailed, and the Secretary of States Office has issued a letter of non-
action. This means that no action will be taken against the budding
financial giant of Julietta, and that the name of the First Bank of Pizza
will remain tall and proud forever. Ms. Sherman should now be able to reapply
for her wine and beer permit.
Justice has prevailed and I hope that the First Bank of Pizza gets some
publicity out of this to make up for the inconvenience and lawyers fee
incurred. The next time you drive through Julietta might stop and visit
the First Bank of Pizza and remember that a small, local business won a
small of significant victory.
