The Toucans applied for a US Trademark in 1993 to protect their name, but
the Kellogg's Company filed a lawsuit in 1994 to block their application.
Kellogg's claimed that the band's name was an imitation of the cereal
company trademark, Toucan Sam. Kellogg's also claimed that damages to
Kellogg's have resulted because of the band's name.
The Toucans say they derived their name from a pun relating to the
instruments they play. Made from used oil barrels, the Steel Drum was
invented on the island of Trinidad 50 years ago. Although the Toucans have
been playing in the Northwest for close to 10 years, they still haven't
figured out how to eat a steel drum for breakfast.
To save The Toucans, send a message to Kellogg's lawyers at: jhkau@oblon.com.
Tell them why *you* think they should stop opposing the band's trademark.
Mention the case (Kellogg's vs. Toucans, trademark dispute), and let
Kellogg's know that this kind of action can only harm their public image.
Then, send this message to other people that enjoy dancing to the Toucans.
