2. Approval of Renewal of Alcohol and Restaurant Licenses for Year 2003 - Chris Bainbridge
The liquor license renewal process for calendar year 2003 is nearly complete, although some applicants are still working toward full compliance with all City Requirements. Approval of all renewals is required before licenses can be issued.

3. Approval of Renewal of Secondhand Dealers and Pawnbroker Licenses for Year 2003 - Chris Bainbridge
"The Little Pawn Shop" has submitted an application and fee for renewal of its Secondhand Dealer/pawnbroker license for the year 2003. The Moscow Police Department has recommended approval.

4. Approval of Secondhand Dealer and Pawnbroker License for Year 2003 - Chris Bainbridge
Steve Myers, owner of Palouse Empire Antiques, 206 S Main has submitted an application and fee for a secondhand dealer/pawnbroker license for the year 2003. The Moscow Police Department has recommended approval.

5. Proposed Amendment to Change Moscow City Code Title 9 to Conform to State Alcohol Code - Chris Bainbridge
The State of Idaho Alcohol Beverage Code has been amended (effective January 2002) to require that all licenses shall expire at 1:00 o'clock a.m. on the first day of the renewal month which shall be determined by the director, and shall be subject to annual renewal upon proper application. The director will determine the renewal month by county based on the number of current licenses within each county, and the director may adjust the renewal month to accommodate population increases. The new renewal month for Latah County is February.

6. Adelphia Cabletelevision Franchise Extension Request - Randy Fife
The cable television franchise agreement Adelphia has with the City of Moscow, Idaho and the City of Pullman, Washington will expire December 31, 2002, at midnight. Although negotiations and preparations for franchise renewal have been occurring for some time, it is the opinion of both city attorneys that an extension of the current franchise with all of its conditions until March 31, 2003 will facilitate the resolution of the matter. Adelphia representatives agree with the term and the conditions of the extension.

3. Arboretum Xeriscape Project - Tom Scallorn
The Moscow Water Department has participated with the University of Idaho Arboretum to develop a low water use demonstration garden (Xeriscape). The first expenditure was in the FY01 budget and this third expenditure from the FY03 budget will complete the project construction. The expenditure for the FY03 budget will be primarily for signage and has been budgeted at $3,000.00
ACTION: Concur with staff to expend funds; or take such other action deemed appropriate.
4. Ratification of Agreement to Transfer Property (Trail Quitclaim Deed) From Latah County to City of Moscow - Gary J. Riedner
Latah County wishes to transfer ownership of a portion of public right-of-way to City of Moscow, Idaho for use as a pedestrian/bicycle path, after determining that such transfer is in the best interest of the public. Pursuant to Idaho Code Title 67, Chapter 23, a written agreement has been made between Latah County and City of Moscow for a conveyance of real property without consideration. Latah County is record owner of property generally described as abandoned railroad right-of-way between Styner Avenue and Carmichael Road. The County previously granted a permanent easement to the City and both entities now desire a full transfer.

5. Insurance Claims for Compensation - Mark Cook
a. Mildred Eldredge/Dennis Conrad:
A claim was received on March 7, 2002 alleging water leaking from an area fire hydrant.
ICRMP denied the claim March 25, 2002
b. Jon Decker:
This claim involved financial loss associated with August 3, 2002 Moscow Well #9 ceasing
pumping. ICRMP denied the claim for compensation.
ACTION: Deny compensation for alleged damages.

2. 7:30 p.m. Public Hearing: Comprehensive Plan Map Amendment to Change the Designation of that part of Sixth Street located between Deakin Avenue and Perimeter Drive, from a Minor Arterial or a Collector Street to a Local Street - Joel Plaskon
Although that part of Sixth Street located between Deakin Avenue and Perimeter Drive carries vehicular through traffic, it is a pedestrian priority area for the University of Idaho campus. Pedestrian activity along this portion of Sixth Street is very high causing the need for reduced vehicular traffic speed and the need for better vehicular and pedestrian traffic management. Downgrading this portion of Sixth Street to a local street designation will allow the Public Works Department to implement traffic improvements consistent with the Manual on Uniform Traffic Control Devices. The Transportation Element of the Comprehensive Plan specifically mentions that Sixth Street, when it passes through campus, encounters heavy pedestrian and bicycle traffic such that increases in through vehicular traffic should be discouraged in that segment. The Planning and Zoning Commission held a public hearing September 25, 2002 and recommended approval. The Transportation Commission supports the amendment. The remaining portion of Sixth Street east of Deakin Avenue would remain designated as a Collector or Minor Arterial Street.
ACTION: After holding public hearing: reject resolution; or accept resolution downgrading that part of Sixth Street located between Deakin Avenue and Perimeter Drive from a collector street or a minor arterial street to a local street; or take such other action deemed appropriate.
3. 7:35 p.m. Public Hearing: Comprehensive Plan Land Use Designation Amendment and Rezone Consideration for 226 Baker Street - Joel Plaskon
The subject property is approximately 12 acres in size and undeveloped but farmed ground. It is currently designated on the Comprehensive Plan Map as Medium Density (MR) Residential. The property owner, Mr. Robert Peterson, has filed an application to rezone the property from Farm, Ranch and Outdoor Recreation (FR) Zoning District to Multiple Family Residential (R-4) Zoning District which necessitates the need to amend the Comprehensive Plan Land Use Designation from MR to HR. On September 25, 2002, the Planning and Zoning Commission held a public hearing and recommended denial of the Comprehensive Plan Map land use designation amendment and recommended denial of the rezone. Staff has been recently contacted by the Army Corps of Engineers Walla Walla office and told that it is believed that there are wetlands on the subject property, therefore likely requiring the applicant to obtain related permits from the Army Corps of Engineers prior to any fill or development of the property.
ACTION: After holding public hearing:
1. Reject Resolution; or Approve resolution amending the Comprehensive Plan Map Land Use Designation of the subject property and authorize the Mayor's signature thereon; or take such other action deemed appropriate.
2. Reject ordinance; or Consider ordinance on first reading; or approve ordinance under suspension of the rules requiring three complete and separate readings, that it be read by title only; and authorize the Mayor's signature thereon; or take such other action deemed appropriate.
4. 7:50 p.m. Public Hearing - Comprehensive Plan Map Land Use Designation Amendment and Rezone Consideration for Latah County Courthouse and associated properties, the First Presbyterian Church and associated properties, the Moscow High School and associated properties, and the 1912 Center and associated properties - Joel Plaskon
The applicants propose to amend the Comprehensive Plan Map Land Use and Zoning Designations of six parcels generally described as being located east of Jefferson Street, west of Polk Street, south of Second Street and north of Sixth Street. The subject properties currently host the Moscow School District High School, the Latah County Courthouse, the City of Moscow's 1912 Center and the First Presbyterian Church. Five of the subject parcels are proposed to be changed from Multiple Family Residential (R-4) to General Business (GB) and the remaining parcel from Residential/Office (RO) to General Business (GB). These zoning amendments would allow the applicants to continue and potentially expand their respective uses as permitted uses instead of special, conditional, or nonconforming uses as they currently exist.
ACTION: After holding public hearing:
1. Reject resolution; or approve resolution amending the Comprehensive Plan Map Land Use Designation of the subject properties; or take such other action deemed appropriate.
2. Reject ordinance; or consider ordinance on first reading; or approve ordinance under suspension of the rules requiring three complete and separate readings and that it be read by title only, and authorize the Mayor's signature thereon; or take such other action as deemed appropriate.
5. Agreement to Purchase Property for Fire Station #3 - Randy Rice
Through the design process for the new fire station project, there has been concern about the significant costs resulting from placing the facility on the existing site. It has become apparent that site development costs have risen to the point of questioning the original site selection decision. Staff negotiated an agreement to purchase three lots immediately across Pintail Lane.
ACTION: Authorize purchase of lots and authorize Mayor's signature on the agreement; or take such other action deemed appropriate.

On Monday, December 9, 2002, Council attended a compensation workshop with BDPA, Inc. to discuss the proposed compensation and job evaluation plan and address any questions.
