Bocc proceedings for week of March 6, 2000




COMMISSIONERS’ PROCEEDINGS
Week of March 6, 2000

Commissioners Loreca J. Stauber, Samuel G. Duncan and Paul J. Kimmell met in
regular session.  The following actions were taken:

Approved, signed, filed request for tax cancellation, Ron’s Rocket Shop,
PPR105.  Business and equipment were sold.

Approved, signed, filed request for tax cancellation, Louis Arno estate,
RP41N05W021662.  Survey showed error in assessed acreage.

Approved, signed, filed Tuition aid request for Jessie M. Guske to North
Idaho College.

Adoption of Ordinance #210, amendment to the Uniform Rural Addressing System
Ordinance:  An Ordinance of Latah County, amending the Latah County Uniform
Rural Addressing System Ordinance (#151); establishing responsibility of the
property owner for installation and maintenance of rural address signs;
proving for severability; and providing for an effective date.  This
ordinance shall be in full force and effect from and after its passage,
approval, and publication according to the law.  Passed by the Board of
Latah County Commissioners, this 6th day of March, 2000.

Filed certified letter from Tom Webber regarding Tort Claim, requesting
$35,000 from the county in exchange for his dropping claim.

Motion and Order to reappoint Loreca J. Stauber, Chair of the Board of
County Commissioners to a second term on the Moscow Latah EDC Board of
Directors for 2000 as the County’s representative.

Motion and Order to authorize a letter of intent to the Idaho Transportation
Department’s Off ice of Highway Safety for Section 402 Highway Safety Grant
FY2001 in anticipation of radar and radio help for a total of $64,820
federal funding ($87,462 project total) with Lt. Richard Kramer as project
administrator; application for FY 2001 Section 157 Occupant Protection Grant
for a total of $83,046 federal funding ($105,688 project total) for radio
and radar and personnel assistance with Lt. Richard Kramer as project
administrator.

Resolution 2000-04 ordering special election for issuance of a General
Obligation Bond, not to exceed $4.2 million; setting the date, time and
place of election; notice of election; and providing for other matters
related thereto.  Passed and adopted this 6th day of March, 2000.

Motion and Order, pursuant to Article 18, Section 6, of the Idaho
Constitution, and to the financial interest of Latah County pursuant to
Idaho Code 57-217, retain separate Bond Counsel; Authorize the Chair’s
signature on Special Services Contract between Latah County and Preston
Gates & Ellis LLP to act as bond counsel for the upcoming Fairgrounds Bond
Issue, not to exceed $7,900.00 plus out of pocket expenses.

Having held a public hearing as provided by law, Motion and Order to approve
the Lowry Conditional Use Permit #590, contingent upon the conditions as set
forth in a memorandum from the Planning and Building Department, dated March
3, 2000, Exhibit 13 with amendments as discussed concerning caliper of trees
and setback requirements.  Minutes and tape are on file in the Auditor’s Off
ice.

Convened in Executive Session at 10:07 A.M. on March 8, 2000 to discuss
Indigent matters, pursuant to Idaho Code, Section 67-2345 (1)(d).  Adjourned
at 10:37 A.M.  Eight cases approved, two cases denied.

Approved, signed filed request to fly over congested areas when absolutely
necessary by Craig Fountain, Fountain Flying Service; agrees to meet all FAA
requirements concerning application and passing over congested areas; will
submit a written plan to the FAA for approval prior to spraying; will hold
the county harmless for damages as a result of spraying operation; will post
public notice prior to spraying in accordance with FAA requirements.

Approved, signed, filed Commissioners’ Proceedings for week of February 28,
2000.

Approved, signed, filed Findings of Fact and Conclusions of Law; therefore
the Board of County Commissioners approves this request by Bill Lowry for
Request to Rezone (#589) a 3.25 acre portion of a 6.4 acre parcel from
Single Family Residential (RS-9.6), to Agriculture/Forestry (A/F).  The
property is located on the north side of State Highway 6 and west of
Reynolds Road, in Section 9, Township 41 North, Range 4 West, B.M., in Latah
County.  Passed the 8th day of March, 2000.

Approved, signed, filed Findings of Fact and Conclusions of Law regarding a
petition by Bill Lowry, for a Conditional Use Permit (#590) to establish a
shop, office and dispatch center for Lowry Trucking.  The property is
located on the north side of State Highway 6 and west of Reynolds Road, in
Section 9, Township 41 North, Range 4 West, B.M., in Latah County.  Passed
the 8th day of March, 2000.

Approved, signed, filed an Ordinance of Latah County (#211), amending Latah
County Zoning Ordinance of 1980 (Ordinance #29, as previously amended);
changing the zone classification for a parcel of land in Section 9, Township
41 North, Range 4 West B.M. from single family residential (RS-9.6) to
Agriculture/Forestry (A/F); and providing for Ordinance #211 to be in full
force and effect from and after its passage, approval and publication
according to law. Passed the 8th day of March, 2000.

Filed letter from Fair Board regarding meeting with Palouse Ice Rink
Association (PIRA), who propose using fairgrounds facilities in off-season
to house ice rink.
