1. Consent Agenda: Any item will be removed from the consent agenda at the
request of any member of the Council and that item will be considered
separately later. Approval by roll call vote.

B. Approval of Minutes of August 11, 1997 City Council Meeting

C. Accounts Payable for the Month of July, 1997 - Jim Wallace
Public Works/Finance Committee reviewed accounts payable for the month of
July, 1997 and recommends approval of the following:
General $347,756.42
Parks & Recreation 73,621.93
Arts 4,086.13
Street 170,317.97
911 12,720.24
Bond & Interest 182,440.00
Water & Sewer 257,825.78
Sanitation 180,740.09

D. Street Closure Request/Galactic Tofu Farmers - Chief Weaver
The Galactic Tofu Farmers have requested the closure of Main Street between
3rd and 4th Streets on September 13, 1997 between the hours of 5:00 p.m.
and 1:00 a.m. to hold a street dance. There will be two live bands and
they are also requesting an exemption from the noise ordinance. Reviewed
by Administrative Committee on 8/13/97.

ACTION: Approve request for street closure and exemption from the noise
ordinance.

E. Beer, Wine and Liquor License Transfer for Cadillac Jacks at 112 North Main
from Terry Raugust to Philip Roderick - Elaine Russell

ACTION: Approve transfer of license at Cadillac Jacks

F. Indian Hills Booster Pump Station Bids - Gary Presol
A 1997 budgeted project is to replace the Indian Hills water booster pump
station located under the sidewalk on Indian Hills Drive immediately above
the Northwood intersection. The existing station is undersized and in
disrepair. Four bids were received, they were: Germer Construction, Inc. -
$85,646; Wind River Construction, Inc. - $99,532; Willms Corporation -
$100,000; William Bros. Construction, Inc. - $109,500. The Engineer's
estimate was $81,358. Kimball Engineering has performed the engineering.
$95,000 is budged for the project - less a $12,000 engineering fee (which
includes construction services) $83,000 is available for construction.
Staff recommends award of contract to the low bidder, Germer Construction,
Inc. Reviewed by Public Works/Finance Committee 8/25/97.

ACTION: Accept low bid from Germer Construction, Inc. and authorize
Mayor's signature on contract.

2. Public Hearing - 7:30 p.m. - Consideration of Annexation and Zoning of
a One Acre Parcel of Land Located North of West 'A' Street - Dale Pernula
Stepping Stones, Inc. is requesting annexation and zoning (R-4, Multiple
Family Residential) of a one acre parcel of land located north of 'A'
Street and east of Farm Road as shown on the attached maps for the purpose
of developing a supportive housing development for developmentally disabled
adults. A public hearing was held on this matter by the Planning and
Zoning Commission on July 23, 1997 (minutes enclosed).

ACTION: Reject proposal; or approve annexation and zoning as requested
and adopt attached ordinance on first reading or under suspension of the
rules requiring three complete readings and that the ordinance be read by
title only. Findings of fact must be made on the zoning issue.

3. Public Hearing - 8:00 p.m. - 1998 Budget - Jim Wallace
The proposed budget is presented for consideration by the Council and to
allow for public comment regarding the formal adoption of the 1998 fiscal
year budget. The printed budget proposal incorporates departmental
requests and represents the consensus of the Council at the budget workshop
session held in July.

ACTION: 1) After close of public hearing make a motion for adjustments (if
any) to the proposed budget; 2) adopt the annual budget by adopting the
'Annual Appropriation Ordinance' under suspension of the rules requiring
three full and complete readings and that the ordinance be read by title
only; 3) approve the 'Dollar Certification of Budget Request to the Board
of County Commissioners'; and authorize Mayor to sign the necessary documents.

4. Palouse Trail Bids - Randy Rice
On August 1, 1997 bids were opened for construction of the Palouse Trail
from the state line to Perimeter Drive. Only one bid was received - from
Poe Asphalt. Poe submitted a base bid of $87,885.05 and a bid alternate of
$36,278.14. The total bid amounted to $124,163.19. Engineering estimates
from consulting engineers was a base bid of $76,238.50, bid alternative of
$27,201.20 and a total of $103,439.70. For the reasons contained in the
accompanying memo, it is a recommendation of staff and the consulting
engineers that the bid be accepted. Reviewed by Public Works/Finance
Committee 8/25/97.

ACTION: Accept the bid from Poe Asphalt and authorize Mayor's signature
on the contract, or reject bid and direct staff how to proceed.

5. Ordinance Adopting Uniform Building Codes - Larry Betts
The Technical Code Review Committee has completed its review of the 1994
Edition of the Uniform Building Code, 1994 Edition of the Uniform Plumbing
Code, 1996 Edition of the National Electrical Code, 1994 Edition of the
Uniform Administrative Code, 1994 Edition of the Uniform Code for the
Abatement of Dangerous Buildings, 1994 Edition of the Uniform Housing Code,
and the 1994 Edition of the Uniform Mechanical Code. The attached
ordinance has been prepared adopting these codes and outlining any
additions or deletions from the Uniform Codes. Reviewed by the
Administrative Committee on July 2, 1997.

ACTION: Consider ordinance on first reading; adopt the attached ordinance
under suspension of the rules requiring three separate and complete
readings and that the ordinance be read by title only or take such other
action as the Council deems advisable.

6. Amendments to Moscow City Code Chapter 1, Title 10 - General Offenses -
Dan Weaver
Moscow Police Department has requested the drafting of two ordinances in
order to address some common problems. The trespassing ordinance is meant
to allow enforcement against individuals who are not welcome on private
properties after they have been given notice they are not allowed on the
property. The ordinance regarding the throwing substances at vehicles and
occupants is designed to address the continuing problem with paintball
guns, water balloons, slingshots, rocks, etc. which interfere with the safe
operation of the vehicles.

ACTION: Consider ordinances on first reading; adopt ordinances under
suspension of the rules requiring three separate and complete readings and
that the ordinances be read by title only; or take such other action as the
Council deems advisable

7. Resolution Adopting Certain Sections of the Comprehensive Plan - Dale
Pernula
The enclosed resolution adopts eight updated elements of the Moscow
Comprehensive Plan. All seven elements have been approved by the Planning
and Zoning Commission and the City Council after duly conducted public
hearings. The Comprehensive Plan is enacted by resolution and this action
is necessary in order that Latah County formally adopt the most current
Moscow Comprehensive Plan for applicability in the Moscow Area of Impact.
Reviewed by Administrative Committee on 8/20/97.

ACTION: Adopt enclosed resolution or reject resolution and take any other
action deemed appropriate.

8. Personnel Guideline Changes - Leslie Moss
The City of Moscow Personnel Policy Manual has been revised in its entirety
with extensive input and cooperation from the Employee Advisory Committee
and Department Heads. The manual has been reviewed by the Administrative
Committee and their recommended changes have been made. Also, the City of
Moscow Safety Handbook has been reviewed by employees, department heads and
the Administrative Committee. Minor changes suggested by the
Administrative Committee have been made.

ACTION: Adopt Personnel Policy Manual as presented or direct staff to
revise per Council action.

9. Proposed 1912 Moscow High School/Whitworth Building Offer - Gary J. Riedner
The attached memo outlines a history of the City's negotiations with Moscow
School District #281 involving the 1912 Moscow High School/Whitworth
Building. Also attached is the letter dated June 26, 1997 from Karen
Falke, Chair of the Board of Trustees, outlining the School District's
position. The attached memo reflects discussions of the Council at the
July 22, 1997 budget workshop and proposes that an offer be made to the
School District based upon those discussions. Reviewed by Public
Works/Finance Committee 8/25/97.

ACTION: Approve submission of an offer to purchase the 1912 Moscow High
School/Whitworth Building in conformance with the attached memo and submit
to the Moscow School District prior to September 1, 1997, or take such
other action as the Council deems necessary.

10. Resolution Supporting Construction of a Traffic Signal at the
Intersection of
U.S. Highway 95 and Styner Avenue/Lauder Street - Marshall Comstock
