Visionaries,

The county planning commission went back to the table after their last
public hearing and revised the proposed ordinance regarding rural
residential zoning. Thanks to Gerard Billington, the draft proposal is
posted here.

There was considerable disagreement in the county about the previous draft
proposal. I urge everyone interested in this issue to examine the new
proposal carefully.

Although I haven't yet learned the date of the public hearing, we will
advise you of it as soon as we know the date. It could be late April or
early May.=20

=09ARTICLE 9 LAND DIVISION IN AGRICULTURE/FOREST ZONE

SECTION 9.01 REQUIREMENTS FOR LAND DIVISION

The number of land divisions permitted in the Agriculture/Forest =20
Zone shall depend on the total acreage of the existing parcel and=20
the number of acres of less productive soil on that parcel. At=20
least 3/4 of each new parcel approved based on the less productive=20
acreage of the existing parcel shall be located on the less=20
productive acreage. To be eligible for one residential building=20
permit, a new parcel must be at least one acre and receive the=20
following approvals:

=091)=09Adequate sewage disposal facilities can be located on=20
the new parcel as demonstrated by written approval from=20
the North Central District Health Department, and =20

=092)=09Adequate access is provided by parcel frontage to a=20
public road. If any new parcel or remnant of an=20
existing parcel does not front a public road, the parcel=20
must have a recorded easement of at least 25 feet in=20
width which connects to a public road. Access to a=20
public road, either direct or by easement, will require=20
written approval from the jurisdiction maintaining the=20
accessed public road, and=20

=093)=09Any new parcel must be surveyed and comply with Title=20
55, Chapter 19, Idaho Code. The survey shall be=20
verified by the County Surveyor prior to filing.

SECTION 9.02 DEFINITION OF PRODUCTIVE SOIL TYPES

For purposes of this Article, productive soil types are defined as=20
those mapped soils from the 1981 "Soil Survey of Latah County Area,=20
Idaho", U.S. Department of Agriculture, including soil type # 3, 4,=20
12, 13, 14, 15, 16, 20, 21, 22, 23, 26, 27, 28, 29, 31, 32, 33, 34,=20
35, 36, 37, 50, 51, 52, 53, 56, 57, 58, 59, 60, 61, 62, 63, 64, 65=20
and soils on all lands not included in that soil survey. Less=20
productive soil types are defined as all remaining soil types.

SECTION 9.03 LAND DIVISION IN THE AGRICULTURE/FOREST ZONE

Existing parcels with at least ten but less than forty acres of=20
less productive soil types are eligible for one land division. =20
Existing parcels with forty or more acres of less productive soil=20
types are eligible for two land divisions. =20

SECTION 9.04 DIVISION OF 160 ACRE PARCELS
=20
Existing parcels in the Agriculture/Forest Zone of at least 160=20
acres, regardless of soil type, are eligible for one land division=20
for each 160 acre portion of the existing parcel. These divisions=20
are in addition to those earned under =A79.03.

SECTION 9.05 DIVISION OF NEW PARCELS

Subdivision of new parcels, or existing parcels not eligible for=20
division under the provisions of =A79.03 or 9.04 shall not be=20
eligible for residential or commercial building permits unless the=20
owner of the new parcel receives County approval for rezoning and a=20
subdivision plat.=20

SECTION 9.06 DEFINITION OF EXISTING AND NEW PARCELS

All parcels of land recorded or approved by the Planning Department=20
on or before January 1, 1997 shall be considered existing parcels.=20
Conveyance of title, or contracts which provide for conveyance of=20
title, to portions of existing parcels which are executed after=20
January 1, 1997, shall be deemed to create new parcels. To be=20
eligible for residential building permits, these new parcels shall=20
be created in compliance with the provisions of this ordinance.
